Counting 14 Leaves instead of 4 Leaves If An Employee Called on Duty during Vacation (In a Month) Punjab

I am sharing the rules for Counting Leaves if an Employee called on Duty during Vacation. These extracts are from the Punjab ESTACODE 2007 Punjab Leave Rules. As per the rules, if an employee performs a full month of duty during the summer vacation, he will get nearly 18 days leave if there are 65 days of summer vacation.

Counting Leaves If An Employee Called on Duty during Vacation

The rules for counting leaves to be credited in the Leave account for the employees who perform duty during summer or winter vacation are as follows:

If the employee performs the duty the whole year, even during summer/winter vacations
If the employee avails a full vacation
When an employee partially performs duty during vacationIf the employee performs the duty the whole year, even during summer/winter vacations

If a civil servant performs duty the whole year and the employee is called for duty during summer or winter vacation, the leaves will be credited just as the employee who has no winter or summer vacation (Non-Vacation Department). The Non-Vacation Department employee gets 4 leave days for each full calendar month. This employee will also get 4 leaves per month and thus a total of 48 leaves for the whole year.

If the employee avails a full vacation

If the vacation department employee avails all vacation, then the employee will get 1 leave for each full calendar month.Example:

Mostly the teaching staff avail vacation from 1st June to 15th August. The counting of leaves will be as under:

  • January 01 Leave
  • February 01 Leave
  • March 01 Leave
  • April 01 Leave
  • May 01 Leave
  • June 00 Leave
  • July 00 Leave
  • August 01 Leave (Duty Performed is 16 Days, so the full calendar month will be counted)
  • September 01 Leave
  • October 01 Leave
  • November 01 Leave
  • December 01 Leave

Total Leaves 10 Leaves

Some employees count 9 leaves for a teaching staff, which is not the correct way. There may be 9 leaves for the teaching staff. If the teachers have a vacation in August 16 days or more, then we shall count 9 leaves in a year. Simply, if you have performed duty for 16 days or more, you will get one leave, and if 15 days or fewer, then no leave.

When an employee partially performs duty during vacation

If the employee performs some days’ duty during summer/winter vacation, then the rules is different as under:

“ When he avails himself of only a part of vacation—as in (a) above, plus such proportion of thirty days as the number of days of vacation not taken bears to the full vacation”

This statement/clause is very interesting. According to this clause of leave rules, if the employee performs duty during a vacation, the mathematical form of the above statement will be as under:

Total Leaves Credit =

Number of Days duty performed during vacation x 30

Total No of Vacation

Suppose an employee performed 40 days of duty during summer vacation, and there are a total of 66 days of summer vacation, then the leave count is as follows:

Total Leave to Credit in Leave Account

= 40 x 30

66

= 20

So the employee will have 20 leaves extra as well as 10 leaves of routine for the other months’ duty.
